JUDGMENT : MAHABIR SINGH SINDHU, J. CRM No. 9202 of 2018 1. Application has been filed for impleadment of the complainant as respondent No.2. 2. Notice of the application to the non-applicant. 3. Learned Counsel for the petitioner is not seriously objected to implead the complainant as respondent No.2. 4. Consequently, for the reasons stated in the application, the same is allowed as prayed for subject to all just exceptions. 5. Sanjeev Kumar s/o Bal Mukand is ordered to be impleaded as party respondent No.2. Amended memo of parties is taken on record. Registry to tag the same at the appropriate place. 6. Learned Counsel for the petitioner accepts notice on behalf of the non-applicant/petitioner and he has no objection in case the amount is released subject to final outcome of the litigation between the parties. 9. Consequently, the present application is allowed and the amount in question i.e. Rs.5 Lakh, deposited by the petitioner with the Registry of this Court, shall be released to the complainant/respondent No.2 but that shall be subject to the final outcome of the FIR No.199 dated 21.07.2017, under Section 420, IPC, registered at Police Station City Khanna, District Ludhiana. 10. CRM stands disposed off. MAIN CASE 11. Learned Counsel for the petitioner has contended that in terms of order dated 16.01.2018, the petitioner has already joined the investigation and that fact is duly acknowledged by learned State Counsel, on instructions from ASI Parmod Kumar, Police Station City, Khanna, by submitting that the petitioner has joined the investigation on two occassions i.e. 19.02.2018 and 03.03.2018 and his custodial interrogation is no longer required in this case. 12. In view of above, the interim order dated 16.01.2018 is made absolute, subject to the conditions as envisaged under Section 438(2) Cr.P.C. and the present petition stands disposed off.
