JUDGMENT Augustine George Masih, J. - Custody certificate has been filed in Court, taken on record. 2. Copy supplied to the counsel for the applicant-appellant. 3. Appellant is in custody since 11.05.2014 and although during the trial, he was released on bail on 20.11.2014 but since he was involved in another FIR, where he continued to be in custody, which resulted in his acquittal, the said period needs to have been taken into consideration for the actual custody period of the appellant in the present case as all through he had been in custody. The actual custody period of the appellant comes to more than four years. The appeal is not likely to be heard in near future. Therefore, the present application is allowed. 4. Remaining sentence of the applicant-appellant is suspended during the pendency of the appeal. He be released on bail to the satisfaction of Chief Judicial Magistrate, Ludhiana. 5. It shall be open to the Court to impose strict conditions while granting him bail. 6. Apart from condition to be imposed, in case the appellant is found involved in any other case during the pendency of his suspension of sentence, the concession granted by this Court shall be deemed to have been withdrawn. 7. It would also be open to the prosecution to move an application for cancellation of bail in case the appellant violates any of the terms of the conditions as imposed by the Chief Judicial Magistrate, Ludhiana.
