ORDER 1. By this public interest litigation filed by the petitioner a prayer has been made to stop illegal sand mining, which is going on by the contractor of M.P. State Mining Corporation Limited. The allegation is that without paying the royalty amount they are lifting and transporting the sand. 2. Considering the aforesaid, we issued notices and also directed the respondents No.1 to 6 to inspect the area and submit the report. After the report it has been found that mining contractor has lifted total 8,676 cubic meter of sand, outside the grant area. The Collector initiated proceedings under the provisions of M.P. Miner Mineral Rules, 1996 and directed to pay the royalty amount along with penalty. This order has been challenged by the mining contractor by filing an appeal before the Director of Geology and Mining Department/Government of Madhya Pradesh, Bhopal under section 57 of M.P. Minor Mineral Rules, 1996 and the matter is still pending for consideration before the appellate authority and now sand mining policy has been changed. At present no one on behalf of M.P. State Mining Corporation Limited is carrying out the sand over the area in question, though contract has been awarded by the M.P. State Mining Corporation Limited for lifting the sand but in pursuance to the notification issued by the Mining Resources Department of the Government of Madhya Pradesh on 23.5.2017 all mining operations for lifting the sand has been suspended. 3. In view of the aforesaid notification dated 23.5.2017, at present no mining over the area in question is going on. Considering the aforesaid, no useful purpose will be served in keeping the Writ Petition pending as fine has already been imposed and matter is pending before the appellate authority, therefore, we dispose of this Writ Petition by directing the respondents/Officers of the Mining and Revenue Department to take an appropriate action, so that no illegal mining be carried out over the area in question. With the aforesaid Writ Petition No.167/2014 (PIL) is disposed of.
