JUDGMENT Mr. Anita Chaudhry, J.:- CRM-5686-2018 1. Application is allowed as prayed for and statements of PW-1 and PW-2 as Annexure P-3 (colly) is taken on record. CRM-M-44027 of 2017 2. This is the second petition filed by the petitioner seeking regular bail in FIR No.30 dated 27.01.2016 registered at Police Station Focal Point, Ludhiana under Sections 304-B and 120-B of IPC. 3. The first application bearing CRM-M-44790 of 2016 was dismissed on 03.2.2017 by the Coordinate Bench of this Court and the trial Court was directed to expedite the trial. 4. Learned counsel for the petitioner contends that the petitioner is the husband who is in custody since 29.01.2016. Counsel urges that 5 witnesses have already been examined. He further contends that Phoola Ram, father of the deceased, lodged a missing report but therein no allegations had been made with respect to dowry demand and the petitioner was found in the canal and it was not a case of dowry demand. Learned counsel further states that two sisters were married in the same house and there is no dispute with the second daughter. 5. In the missing report lodged by the father, it was only stated that there was a dispute and his daughter had left home without informing anyone. The body was found by unknown person who informed the police. 6. The petitioner is in custody for over 2 years and the trial is taking time. Keeping in view the circumstances and the period of custody, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
