JUDGMENT Mr. Jitendra Chauhan, J. (Oral):- Custody Certificate has been filed in the Court. The same is taken on record. 2. This is second bail application filed under Section 439 Cr.P.C seeking bail in case FIR No.52 dated 30.04.2017 registered under Sections 376 and 506 IPC at Police Station Tapa Mandi, District Barnala. 3. Learned counsel for the petitioner contends that the the petitioner has been falsely implicated in the present case. He is in custody since 02.05.2017. The prosecutrix was a consenting party. This is second bail application. The first was dismissed on 06.10.2017. The prosecutrix has now been examined. 4. On the other hand, the learned State counsel opposes the bail application. Heard. 5. Considering the fact that the petitioner is in custody since 02.05.2017 and the material witnesses have been examined, without commenting on the merits of the case, this petition is allowed. The petitioner be admitted to bail during the pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of trial Court/duty Magistrate concerned. 6. Anything said herein above shall not be construed as an expression of opinion on the merits of the case.
