ORDER 1. We have heard the learned counsels for the parties. 2. Leave granted. 3. The accused appellant has been in custody since 26th September, 2016. The trial has not yet commenced. The co- accused has also been enlarged on bail. Taking into account the period of custody suffered and the likely time that will be taken to finalize the trial, we are inclined to release the appellant on bail. Therefore, the appellant is ordered to be released on bail to the satisfaction of the learned trial Court in connection with FIR No.605/2016 dated 25.9.2016 registered at P.S. Town, East Champaran Sadar (Bihar) under Sections 399, 402 IPC and Sections 25(1B)a, 26 and 35 of the Arms Act. 4. The learned trial Court is free to impose appropriate condition(s) as it deems fit. 5. Consequently, the order of the High Court is set aside and the present appeal is disposed of in the above terms.
