JUDGMENT Sanjay Karol, ACJ. (Oral) - We have interacted with the Sub Divisional Magistrate, Dehra. He informs the Court that a sum of Rs. 50,000/- for repair of the path already stands sanctioned by him and if the path to the Basti is to be constructed, a huge amount would be required, which is beyond his jurisdiction. 2. Under these circumstances, learned counsel for the petitioner prays that liberty may be reserved to the petitioner to approach respondents No. 1 to 3, i.e. State of Himachal Pradesh through Secretary (Rural Development & Panchayati Raj) to the Government of Himachal Pradesh, Shimla-2, Deputy Commissioner, Kangra at Dharamshala, District Kangra, H.P. and Director (Panchayati Raj), Himachal Pradesh, Shimla, respectively, venting out all grievances. 3. Joginder Singh, private respondent No. 6, in fact, at some point of time, had allegedly agreed for repair of the path and has entered into an agreement and has issued no objection for repair of such path. 4. Under these circumstances, petition stands disposed of with a direction that in the event of petitioner approaching respondents No. 1 to 3, i.e. State of Himachal Pradesh through Secretary (Rural Development & Panchayati Raj) to the Government of Himachal Pradesh, Shimla-2, Deputy Commissioner, Kangra at Dharamshala, District Kangra, H.P. and Director (Panchayati Raj), Himachal Pradesh, Shimla, respectively, within a period of two weeks from today, the said respondents shall take appropriate action, in accordance with law, within a period of two months thereafter. Pending applications, if any, also stand disposed of.
