JUDGMENT : Nelson Sailo, J. Heard Mr. S.C. Biswas, the learned counsel for the petitioner and Mr. D.C. Borah, the learned CGC appearing for the respondent Nos. 1 to 4. 2. The claim of the petitioner is for family pension since her late father was employed as Safaiwala under the establishment of the respondent No. 3. He expired on 06.10.1996. The father expired while he was in service and consequently, her mother Kadami Basfore was given family pension under PPO No. G/ENG/FP/63/2/98 dated 01.03.1998. However, her mother also expired in the year 2008. Since then, no family pension has been received by the family members. 3. The learned CGC Mr. D.C. Borah submits that pension was not paid to the petitioner only for the reason that she did not apply for the same. However as of now, the respondent No. 3 has taken up the matter with the respondent No. 4 and pension as entitled to the legal heir of the deceased employee will be processed and finalized in due course. 4. Mr. S.C. Biswas also submits that the petitioner was unaware of the scheme under which the petitioner she can receive pension. However, she has now applied for the family pension and the respondent authorities be directed to finalize the same within a time frame. 5. In view of above admitted position, the writ petition need not be kept pending any longer. The writ petition is disposed of with a direction to the respondents, more particularly, the respondent Nos. 3 and 4 to finalize the family pension entitled to the writ petition as expeditiously as possible preferably within a 3(three) months from the date of receipt of a certified copy of this order. 6. It is needles to observe herein that as the matter relates to family pension, the delay in claiming the same by the petitioner shall not be an impediment to finalize and accord family pension as may be entitled to her.
