JUDGMENT 1. We have heard the learned counsels for the parties. 2. Leave granted. 3. The accused appellant who has been charged for commission of offences under Section 302, 201 read with Section 34 IPC has been in custody for a period of about three and half years. The charges are yet to be framed. 4. We have considered the materials on record. Taking into account the totality of the facts of the case we are of the view that the accused appellant should be released on bail. We order accordingly. The appellant is ordered to be released on bail to the satisfaction of the learned Additional Sessions Judge, Pune in connection with Sessions Case No.242/2015 (arising out of FIR No.168/2014 registered at P.S. Wakad, District Pune under Sections 302, 201 read with Section 34 IPC). 5. The learned Additional Sessions Judge, Pune is free to impose appropriate condition(s) as he deems fit. 6. Consequently, the order of the High Court is set aside and the present appeal is disposed of in the above terms.
