body2018
JUDGMENT : Mahabir Singh Sindhu, J. Present petition has been filed under Section 482 Cr.P.C. for quashing of Complaint No.40 dated 02.11.2013 titled 'Lakhbir Singh Gill Vs. Hardev Singh Dhaliwal' (P-1) as well as summoning order dated 28.03.2017 (P-2). 2. It is contended by learned counsel for the petitioner that both the petitioner as well as the respondent are senior citizens and they have amicably settled their disputes. It is further submitted that both the parties were relegated to the Mediation and Conciliation Centre for recording of their statements by this Court on 10.11.2017. 3. In terms of above-said order, statements of both the parties were recorded and a report dated 07.12.2017 has been received from the Mediator to the effect that both the parties have settled their disputes by way of settlement dated 07.12.2017. 4. Perusal of settlement reveals that both the parties have compromised the present matter as well as all other cases mentioned in para No.6 of the settlement. Even otherwise, it has been pointed out that both the parties i.e. petitioner and respondent are retired government employees. 5. Today, the parties are present in Court and they are not disputing the factum of settlement arrived at between them. 6. In view of the above, this Court is fully convinced that the quashing of complaint in question along with all consequential proceedings on the basis of settlement would bring peace and harmony to secure the ends of justice. Accordingly, the Complaint No.40 dated 02.11.2013 titled 'Lakhbir Singh Gill Vs. Hardev Singh Dhaliwal' (P-1); summoning order dated 28.03.2017 (P-2) 09.09.2013 (Annexure P-2) and all the subsequent proceedings arising therefrom, qua petitioner, are hereby quashed and set aside on the basis of settlement dated 07.12.2017. 7. Petition is allowed.
