JUDGMENT : KALYAN RAI SURANA, J. 1. Heard Mr. D. Bora, learned counsel for the petitioner as well as Mr. P.P. Borthakur, learned counsel for the respondent. 2. By this review petition filed under Order XLVII (1) read with section 114 CPC, the petitioner who is the respondent in Tr.P.(C) No.47/2017 has prayed for review of the judgment and order dated 12.09.2017 passed by this Court in Tr.P.(C) 47/17. 3. The grounds for review is that though the petitioner was duly represented by his learned counsel, this Court while hearing a batch of 15 similar Transfer Petitions, had recorded in the order that the petitioner herein had not entered appearance. Accordingly, the grievance of the petitioner is that as the submission of the counsel for the petitioner was not recorded, and that the plea of the petitioner remained unconsidered. 4. Heard the learned counsel for both sides, the learned counsel for the respondent has fairly submitted that the petitioner was duly represented by the learned counsel at the time of hearing Tr.P.(C) NO.47/17. 5. Accordingly, an error has been committed by this Court by not recording the presence of the counsel for the petitioner and that the points raised by him was not taken into account while passing the judgment on the transfer petition. Hence, the petitioner has been able to make out a strong case for exercise of power of review. Accordingly, the judgment dated 12.09.2017 passed in Tr.P.(C) No.47/17 is hereby re-called without affecting the common judgment and order dated 12.09.2017 passed by this Court in the analogous 14 cases decided along with Tr.P.(C) No.47/2017. 6. This review petition stands allowed.
