JUDGMENT : ACHINTYA MALLA BUJOR BARUA, J. 1. Heard Mr. I. Rafique, learned counsel for the petitioner. Also heard Ms. M. Bhattacharjee, learned Additional Senior Government Advocate appearing for the respondent authorities. 2. The petitioner was allotted the work of Restoration of Flood Damaged Kadamtala to Titaguri Pt I & II Road (Ph-1) under CRF for 2005-06 for an amount of Rs. 42,02,005/-, as per the work order No.CE/Commn39/2006-07/6 dated 16.10.2006. 3. It is stated that 90% of the amount due to the petitioner was paid but as the balance amount of 10% was not paid, this writ petition had been preferred. 4. The respondent authorities has filed an affidavit-in-opposition wherein in Paragraph-5 it has been stated that the Additional Deputy Commissioner, Kokrajhar had submitted a physical verification report dated 11.01.2008 before the Deputy Commissioner Kokrajhar wherein it was stated that 100% of the work had been completed as per plan and estimate. 5. In Paragraph-8, it was further stated that when the petitioner had visited the Office of the Deputy Commissioner Kokrajhar on several occasions, the authorities had assured the petitioner that his file is under process and soon he will receive the balance 10% amounting to Rs. 4,16,000/-. 6. The said averment in Paragraph-5 of the affidavit is construed to be an admission by the respondent authorities that the petitioner is entitled to the entire amount for the work he had completed. Accordingly, by following the proposition laid down in Tamsher Ali Vs. State of Assam & Others, (2008) 4 GauLT 1 , it being an admitted amount by the Department, it is directed that the respondent authorities shall pay the balance 10% amounting to Rs. 4,16,000/- within a period of six months from the date of receipt of the certified copy of this order. 7. In terms of the above, this writ petition stands disposed of.
