JUDGMENT : ACHINTYA MALLA BUJOR BARUA, J. 1. Heard Mr. A. K. Sarma, learned senior counsel for the petitioner. Also heard C. K. S. Baruah, learned counsel appearing for the State respondent authorities. 2. The petitioner who is the Officer-in-Charge of Khatkhati P.S. was transferred to the said post on 13.12.2017 but within a short period about 10 months, was again transferred vide order dated 20.10.2018, and closed to the Ordinary Reserve. 3. The petitioner accordingly submitted a representation before the Superintendent of Police, Karbi Anglong, Assam on 21.10.2018 seeking to justify as to why the order dated 20.10.2018 was required to be recalled. It is stated that in spite of such representation being submitted, no consideration had been given to the same. 4. When an order of transfer purportedly in the public interest is being assailed by a representation indicating therein that no public interest was involved, it is incumbent upon the State respondent authorities to give a due consideration to the same and pass a reasoned order thereon. 5. Accordingly, as agreed by the learned counsel for the State, this writ petition is disposed of by directing the Superintendent of Police, Karbi Anglong, Assam to give a due consideration to the representation dated 21.10.2018 of the petitioner and pass a reasoned order thereon. In doing so, the Superintendent of Police shall also give an opportunity of hearing to the petitioner and allow him to produce any material that he may desire to produce in order to substantiate his claim. The aforesaid requirement of passing a reasoned order be done within a period of 2 months from the date of receipt of a certified copy of this order. 6. Till such reasoned order is passed, the petitioner shall remain as the Officer-in-Charge of the Khatkhati P.S and his further continuance thereon shall be decided after the reasoned order is passed. 7. In terms of the above, the writ petition stands disposed of.
