ORDER : ANIL KUMAR UPADHYAY, J. 1. Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as learned counsel appearing on behalf of the BPSC. 2. The issue with regard to eligibility for appointment as Assistant Professor on the strength of obtaining Ph.D degree is now no more res-integra. 3. The Apex Court in the case of P. Sushila reported in (2015) 8 SCC 129 has authoritatively decided that clearing Net is essential eligibility and in view of the judgment of the Apex Court in the case of P. Sushila (supra), the Court does not find any justification to interfere with the selection process undertaken by the BPSC. The subsequent clarification by the UGC so far as pre 2009 Ph.D holders are concerned that may be relevant in subsequent selection process. 4. Considering the above, the Court does not find any merit in the present writ application, accordingly, the writ application is dismissed.
