JUDGMENT : 1. Original Matrimonial Suit No. 103 of 2017 filed by the husband, appellant herein for annulment of the marriage under Section 25 of the Special Marriage Act was dismissed by the learned Principal Judge, Family Court, East Singhbhum, Jamshedpur by the impugned judgment dated 23.03.2017 as the applicant husband had failed to make out any valid cause of action in terms of Section 25 of the Special Marriage Act in relation to any fraud having been practiced on him. 2. Appellant has sought to withdraw this appeal through I.A. No.6379 of 2018 with a liberty to file fresh suit against the respondent wife, according to the provisions of Hindu Marriage Act, 1955. 3. Learned counsel for the Respondent wife is present. 4. Having regard to the prayer made, instant appeal is dismissed as withdrawn. 5. We refrain from making any comment on this, except that if there is any other valid cause of action and such a course is permissible in law, it is up to the appellant to take recourse thereof. I.A. No. 6379 of 2018 also stands disposed of.
