JUDGMENT Shree Chandrashekhar, J. - Prayer in the writ petition is for a direction upon the respondents to pay post-retiral benefits including Provident Fund amount and arrears of salary as claimed under prayer (C). 2. The respondents have filed affidavits in this matter taking a stand that Baidyanath Kamal Kumari Sanskrit Upshastri (Inter) College, Deoghar is an aided affiliated college (Inter level) and the teachers working there are not entitled for pension and other post-retiral benefits. It is pleaded that grant of pension and other post-retiral benefits to the persons working in aided affiliated institutions is a policy matter and at present the government has not taken a decision to pay pension and other post-retiral benefits to the employees of aided affiliated institutions. 3. A similar issue came before this Court in W.P.(S) No.3013 of 2017 and W.P.(S) No.3016 of 2013 and this Court by an order dated 13.10.2017 while dismissing the writ petitions has held that teachers working under Baidyanath Kamal Kumari Sanskrit (Inter) College, Deoghar cannot claim pension/post-retiral benefits. 4. One of the prayers in the writ petition is for payment of Provident Fund amount contribution for which was deducted from salary of the petitioner. On this prayer the respondents are completely silent. Since the petitioner has claimed that contribution in the Provident Fund has been deducted from his salary, a direction is issued to the respondent no.7 to ensure payment of Provident Fund amount to the petitioner, if contributions from his salary were made, within a period of 4 weeks. 5. On the claim for payment of salary for the period during which the petitioner has actually worked, no direction can be issued to the respondent-State. Payment of salary is responsibility of the management of the college, however, if grant against the post on which the petitioner was appointed and worked was released by the State Government, the same shall be paid to the petitioner.
