MAHABIR SINGH SINDHU

body2018
JUDGMENT : Mahabir Singh Sindhu, J. Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.574 dated 20.07.2017, registered under Section 379-B IPC at Police Station Sector 7, Faridabad. 2. It is contended by learned counsel for the petitioner that petitioner is neither named in the FIR; nor any recovery is to be effected from him. It is further contended that report under Section 173 Cr.P.C. has already been submitted and the case is fixed for prosecution evidence for 10.05.2018. 3. On the other hand, learned State counsel has opposed the bail application and submits that there are other criminal cases of similar nature pending against the petitioner. 4. Heard learned counsel for the parties and perused the paper book. 5. Undisputedly, the petitioner is on bail in all the other cases and in the present case out of total 13 prosecution witnesses, none has been examined till date. The trial is likely to take a long time to be concluded and as such no useful purpose would be served by keeping the petitioner behind the bars any more. Therefore, in view of the abovesaid circumstances, without expressing any opinion on the merits of the case, the present petition is accepted. Petitioner-Rohit be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court.
