Birendra Kumar, J. – Heard learned counsel for the parties. 2. This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the “SC/ST Act”) against the refusal of prayer for regular bail vide order dated 06.09.2018 in Special (H) Case No. 18A of 2014 passed by the learned 1st Additional Sessions Judge-cum-Special Judge S.C./S.T. (POA), Act Nawada in connection with Sirdalla (Meskaur) P.S. Case No. 98 of 2011 registered under Sections 147, 148, 149, 342, 323, 325, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act as well as Section 3(1)(x) of the SC/ST Act. 3. Allegation against the appellants is of commission of assault with butt of the pistol. The assault caused by appellant no. 1 Pintu Singh @ Amrendra Singh caused fracture of the left hand of Golu Chaudhary and the assault caused by appellant no. 2 Gorelal Singh caused injury at the forehead of the Md. Irshad. Appellants are in custody since 13.08.2018 and 04.08.2018 respectively. 4. Considering the nature of allegation and completion of investigation of the case, let the appellants, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with the aforesaid case, subject to the condition that the appellants shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the appellants as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below. 5. Accordingly, the impugned order is set aside and this appeal stands allowed.
