ORDER 1. Delay condoned. 2. Appeal admitted. 3. This appeal by special leave is directed against the impugned final order dated 21.12.2013 in Criminal Appeal No. 290 of 1998 passed by the High Court of Judicature at Bombay, Nagpur Bench, Nagpur, Maharashtra, whereby the High Court was pleased to allow the criminal appeal of the respondent - State herein. 4. The present appeal is filed by Accused No.15. The other accused, who have participated in the same offence, having same allegations, filed Criminal Appeal No. 408 of 2014 etc. before this Court, which were allowed by this Court vide reportable judgment reported in (2018) 6 SCC 591 titled as Bhaskarrao and others vs. State of Maharashtra etc. 5. The appellant herein also stands on the similar footing. This fact is not disputed by the learned counsel appearing on behalf of the State. 6. Taking into consideration all the peculiar facts and circumstances of the case, we allow this appeal and set aside the impugned order passed by the High Court and restore the judgment and order passed by the trial Court.
