ORDER : B. Kemal Pasha, J. 1. The mother of the petitioners Mariyakkutty at the age of 70 was found lying murdered at her house wherein she was residing alone, on 04.03.2012. It has come out that she was murdered during wee hours in the course of robbery. She was strangulated, and also she was hit on her head with a blunt object. About 8 sovereigns of gold ornaments, which include 3 bangles, two rings and a pair of earrings, were robbed along with currency notes worth around Rs. 2 lakhs. Some materials like socks, finger prints of the assailants, etc. were seen at the spot. The local police initially conducted the investigation, which did not yield any result even though years elapsed. The shop, from where the socks were purchased, could be located and identified but, the version of the local police was that the CC TV footage of the nearby jewellery, which could cover the premises of the said shop, also was lost from the custody of the police. Subsequently, the investigation was handed over to the Crime Branch. Even though the Crime Branch has also conducted investigation and conducted DNA test, they could not identify the culprits. 2. It is true that almost six years have elapsed and it may not be easy at this stage to trace out the culprits when this much period has elapsed. At the same time, something has to be done in the matter. 3. The learned Standing Counsel for CBI has vehemently opposed the writ petition and has pointed out that the CBI is presently overburdened with investigation of various crimes. It is true that they are burdened with various kinds of investigation at present. At the same time, this Court cannot shut its eyes towards the grievance expressed by the petitioners in the tragic murder of their mother. 4. Presently, therefore, this Court has no other go than again to burden the CBI with the investigation of this case also. The investigation is ordered to be handed over to the CBI. The CBI shall take up the investigation expeditiously. The State Government shall extent all possible assistance required for the investigation of this case by the CBI. They shall grant place for the stay of the officers of the CBI and also give all other facilities required, at the expense of the State.
