JUDGMENT : MAHABIR SINGH SINDHU, J. 1. Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.116 dated 29.05.2014, under Sections 420 and 406 IPC, registered at Police Station City Rajpura, District Patiala. 2. It is contended by learned counsel for the petitioner that the petitioner was granted the concession of bail by learned trial Court and during trial he could not come present on one date i.e. 25.09.2017 on account of the fact that he has noted the wrong date as 15.11.2017 and ultimately, he was arrested on 08.02.2018. It is further contended that out of total fifteen PWs, only seven PWs have examined so far. 3. On other hand, learned State counsel has opposed the bail application on the ground that the petitioner has misused the concession of bail and as such he is not entitled for bail. 4. Heard learned counsel for the parties and perused the paper book. 5. No doubt that the petitioner has abstained from the proceedings on one date i.e. 25.09.2017 before learned trial Court, but in view the fact that he was later on arrested and is in custody since 08.02.2018 and the proceedings are regularly going on. Thus, no useful purpose would be served by keeping him behind the bars any more. 6. In view of the above said circumstances, without expressing any opinion on the merits of the case, the present petition is accepted. Petitioner-Charanjit Singh be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court. 7. It is made clear that petitioner shall fully cooperate with the proceedings before learned trial Court and will not seek any unnecessary adjournments.
