JUDGMENT Ms. Jaishree Thakur, J. (Oral):- The instant petition has been filed under Section 439 Cr.P.C.for grant of regular bail to the petitioner in case FIR No.100 dated24.05.2017, under Section 306/34 of Indian Penal Code, registered at PoliceStation Division 4, Ludhiana, District Ludhiana. 2. Learned counsel for the petitioner contends that the petitionerherein was taken into custody in the aforesaid FIR on 25.05.2017. It isargued that though challan has been presented, charges are yet to be framedon account of the fact that FSL report is still awaited, therefore, thepetitioner is entitled to be enlarged on bail. 3. Learned counsel appearing on behalf of the complainantsubmits that the matter has been compromised between the parties and hewould have no objection in case, regular bail is granted to the petitioner. 4. Per contra, learned counsel appearing on behalf of respondent-State, on instructions from the Investigating Officer, opposes the grant ofregular bail. 5. I have heard learned counsel for the parties. 6. Since, the trial is likely to take some time and in view of thefact investigation is complete, as the challan has already been presented, nouseful purpose would be served in keeping the petitioner behind bars. Atthis stage, without commenting on the merits of the case, the instant petition is allowed and the petitioner is directed to be released on regular bail onexecution of adequate personal bond and surety bond to the satisfaction ofconcerned trial Court/Duty Magistrate.
