MAHABIR SINGH SINDHU

body2018
JUDGMENT : MAHABIR SINGH SINDHU, J. Present petition is filed praying for quashing FIR No. 17 dated 17.02.2016, under Sections 406, 420 and 120-B, IPC, registered at Police Station Sector 19, Panchkula as well as all consequential proceedings arising therefrom. 2. During the pendency of the present petition, an amicable settlement has been arrived at between the parties and consequently they were relegated to the Mediation and Conciliation of this Court and a report dated 05.04.2018 has been received from the Mediator. 3. As per the report of the Mediator, the parties have settled their disputes by way of an amicable settlement/compromise dated 05.04.2018 and the same has been appended along with the report. 4. In terms of the settlement, a demand draft bearing No. 821345 dated 19.04.2018 for a sum of Rs. 5,00,000/- (Rupees Five Lacs) has been handed over to learned counsel for respondent No. 2 today in the Court and he undertakes to hand over the same to respondent No. 2 within three days for further encashment. 5. It is contended by learned counsel for the petitioners that as per the terms of settlement, a sum of Rs. 25 lacs have been paid by the petitioners to the private respondent and the same is duly acknowledged by learned counsel for respondent No.2. Even before this Court also, the parties are not disputing the factum of compromise arrived at between them. 6. On a specific query put to learned State counsel by the Court, he stated that a report under Section 173 Cr.P.C. in this case has not been submitted till date and the matter is pending for investigation. It is further stated that he has no objection in case above FIR as well as all other consequential proceedings arising therefrom are quashed and set aside on the basis of the settlement arrived between the parties. 7. In view of the above, this Court is fully convinced that the offences are entirely personal in nature and do not involve any public funds and thus, quashing of FIR in question along with all consequential proceedings on the basis of compromise would bring peace and harmony to secure the ends of justice. Accordingly, the impugned FIR and all consequential proceedings resulting therefrom, qua petitioners, are hereby quashed. 8. Petition is allowed.
