JUDGMENT P.S. Rana (R) President. - Present revision petition filed under section 17 (1) (b) of Consumer Protection Act 1986 against interim order dated 02.08.2018 passed by learned District Forum Una in consumer complaint No. 65 of 2018 titled Sh. Vishal Ghumman v. Deputy Director of agriculture office Una & Ors. wherein revisionist/opposite party No. 2 was proceeded ex-parte. 2. None appeared on behalf of non-revisionist No.1 despite service. Non-revisionist No.1 is proceeded ex-parte. As per registry report notice sent to non-revisionist No.2 through registered post not received back. More than 30 days expired. Deemed service is effected upon non-revisionist No.2. None appeared on behalf of non-revisionist No.2 despite deemed service. Non-revisionist No.2 is proceeded ex-parte. 3. State Commission is of opinion that it is expedient in the ends of justice and on principle of natural justice that consumer complaint should be disposed of on merits. State Commission is of opinion that no miscarriage of justice will be caused to complainant because complainant will be compensated with heavy costs and due opportunity will be given to complainant to adduce affirmative evidence and rebuttal evidence and due opportunity will be given to complainant to address District Forum on merits. In view of above stated facts present revision petition is allowed and ex-parte interim order dated 02.08.2018 is set aside subject to payment of costs of Rs. 3000/-(Rs. Three Thousand). 4. Costs shall be paid by revisionist before learned District Forum Una to non-revisionist No.1/complainant. Revisionist is directed to appear before learned District Forum Una on 06.11.2018. Learned District Forum shall issue notices to M/s. Jain Irrigation System Ltd. v. Vishal Ghumman & Ors. advocates engaged by complainant and opposite party No.1. Observations shall not effect merits of consumer complaint in any manner and shall be strictly confined for disposal of revision petition. 5. Learned District Forum shall dispose of consumer complaint within two months after receipt of file because proceedings under Consumer Protection Act 1986 are time bound proceedings. Certified copy of order be sent to learned District Forum for compliance forthwith. File of State Commission be consigned to record room after due completion forthwith. Certified copy of order be transmitted to parties forthwith free of cost strictly as per rules. Revision petition is disposed of. Pending application(s) if any also disposed of.
