AMOL RATTAN SINGH

body2018
JUDGMENT : AMOL RATTAN SINGH, J. 1. Pursuant to the order dated 22.03.2018, a status report by way of an affidavit of Sh. Darshan Singh Mann, PPS, Senior Superintendent of Police, District Tarn Taran, has been filed in Court by learned counsel for the State. A copy thereof be given to the learned counsel for the petitioner. 2. As per the said affidavit no connection between the property dispute that the petitioner has with one Sartaj Singh, in respect of which a civil suit is pending, instituted by Sartarj Singh, has been established with the allegations against the petitioner at the instance of the complainant Harjit Singh. 3. Mr. Walia, learned counsel for the State, further submits that in fact Rs.2 lacs are also stated to have been returned by way of a cheque issued by the petitioner to the complainant, which cheque was also dishonoured. 4. Though learned counsel for the petitioner submits that the said cheque was in fact given by way of security to the aforesaid Sartaj Singh in respect of an agreement of sale, learned counsel for the complainant submits that even in the agreement of sale between Sartaj Singh and the petitioner, there is no mention of any such cheque (which according to him he has found out from investigating agency). 5. That being so, without making any comment whatsoever on the actual merits of the allegations against the petitioner and his defence in respect thereof, I see no reason to continue this petition. 6. The petition is consequently dismissed with the interim order vacated.
