JUDGMENT : Mahabir Singh Sindhu, J. The present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.173 dated 28.07.2009 registered under Sections 382, 294, 323, 341, 506 and 34 of the Indian Penal Code at Police Station Jagraon, District Ludhiana Rural. 2. It is contended by learned counsel for the petitioner that the petitioner is in custody since 11.01.2018 and co-accused namely, Swaran Singh, Pawanjeet Singh and Dilbagh have already been acquitted by learned trial Court vide judgment dated 05.12.2012. It is further contended that prosecution evidence is going and out of total 12 prosecution witnesses only one has been examined till date. It is also contended that there is no other case pending against the petitioner. 3. On instructions from ASI Rampal, the above factual position is duly acknowledged by learned State counsel. However, he has opposed the bail on the premises that the petitioner was declared as proclaimed offender on 02.04.2012. 4. Heard learned counsel for the parties and perused the paper book. 5. In view of the fact that the petitioner is in custody since 11.01.2018 and the co-accused of the petitioner have already been acquitted by learned trial Court and although the petitioner was declared proclaimed offender by learned trial Court on 02.04.2012, but he surrendered on 10.01.2018. The trial is likely to take a long time to be concluded and as such no useful purpose would be served by keeping the petitioner behind the bars any more. 6. Therefore, in view of the abovesaid circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner-Amandeep Singh @ Ramandeep Singh @ Amna be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court.
