JUDGMENT : MAHABIR SINGH SINDHU, J. 1. Present petition is filed praying for quashing FIR No.97 dated 30.8.2013 under Sections 420, 465, 468, 471, 120-B of the Indian Penal Code ('IPC' - for short) registered at Police Station Khamano, District Fatehgarh Sahib, on the basis of compromise entered into between the parties. 2. Heard. 3. This Court has passed an order dated 14.12.2017 and operating part of the same reads as under:- “In view of the matter, the parties are directed to appear before the trial Court/Area Magistrate on 2.2.2018 for getting their statements recorded with regard to the compromise arrived at between them. The trial Court is directed to indicate (i) how many total accused are facing the trial, (ii) status/state of the trial/case, (iii) to record the statements of all the concerned parties, with regard to the genuineness and validity or otherwise of the compromise and (iv) to send its report to this Court through District and Sessions Judge, before the next date of hearing. 4. In terms of order dated 14.12.2018, learned Sub-Divisional Judicial Magistrate, Khamanon recorded the statements of both the parties and submitted a report dated 10.4.2018 operating part of the same reads as under:- “xxxxxxx The compromise so entered into is for the benefit and welfare of both the parties and he had resolved to reside peacefully in future. Harchand Singh son of Wariam Singh is also accused in the present case and he has died on 4.11.2016. He has no objection if the present FIR is quashed against the aforesaid accused persons.” During the Course of hearing, the parties are not disputing the factum of compromise arrived at between them, even as on today also. 5. No objection has been raised by the learned State counsel on a specific query put to him by the Court with regard to quashing of the FIR as well as all other consequential proceedings on the basis of the compromise effected between the parties in this case. 6. In view of the above, this Court is fully convinced that the offences are entirely personal in nature and do not involve any public funds and thus quashing of FIR in question along with all consequential proceedings on the basis of compromise would bring peace and harmony to secure the ends of justice. Consequently, the aforesaid FIR and all consequential proceedings resulting therefrom are quashed qua petitioner(s). 7. Consequently, the aforesaid FIR and all consequential proceedings resulting therefrom are quashed qua petitioner(s). 7. Petition is allowed.
