JUDGMENT Ajay Kumar Mittal, J —The prayer made in this writ petition under Articles 226/227 of the Constitution of India, is seeking issuance of a writ in the nature of mandamus directing respondents No.1 to 4 to take strict departmental action against respondents No.5 & 6 for demolishing the Nambardara Bhawan situated at Village Landra, Sirhand Road without any notice and hearing to the petitioner. 2. After arguing for some time, learned counsel for the petitioner submitted that certain disputed questions of fact are required to be proved by leading evidence. Therefore, he may be allowed to withdraw the present writ petition with liberty to the petitioner either to approach the Civil Court or to avail an alternative remedy as may be available to it, in accordance with law. 3. Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies as may be available to it, in accordance with law.
