JUDGMENT : Mahabir Singh Sindhu, J. The present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.207 dated 14.09.2010 registered under Sections 148, 149, 452, 427 of the Indian Penal Code and Sections 3 and 4 of The Prevention of Damage to Public Property Act, 1984 at Police Station Agroha, District Hisar. 2. It is contended by learned counsel for the petitioner that the petitioner is in custody since 02.02.2018 and co-accused namely, Dharampal has already been acquitted by learned trial Court vide judgment dated 17.09.2015. It is further contended that the report under Section 173 Cr.P.C. qua the petitioner was also filed way back on 27.11.2010 and charges are yet to be framed. 3. On instructions from ASI Naresh Kumar, the above factual position is duly acknowledged by learned State counsel. 4. Heard learned counsel for the parties and perused the paper book. 5. In view of the fact that the petitioner is in custody since 02.02.2018 and the co-accused of the petitioner has already been acquitted by learned trial Court. The trial is likely to take a long time to be concluded and as such no useful purpose would be served by keeping the petitioner behind the bars any more. 6. Therefore, in view of the abovesaid circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner-Mangal be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court.
