JUDGMENT : 1. The writ petitioner has brought this action in the form of Public Interest Litigation seeking, in substance, implementation of the National Blood Policy formulated in the year 2002. 2. On behalf of the State Mr. Mishra submits that the policy has been implemented and the State Blood Transfusion Council has also been constituted for the purpose of effective implementation of the National Policy. 3. Mr. Gupta, learned counsel for the petitioner, however, submits that there are still certain deficiencies in implementation of such policy. 4. The issues raised in this proceeding require expertise in the subject. We are of the opinion that Health Secretary of the State may examine the grievances brought by the petitioner on behalf of the general public and for that purpose, hearing may be given to him within a period of 12 weeks from the date of communication of this order. The petitioner shall be at liberty to give a detailed representation before such hearing takes place. On the basis of such hearing, if necessary, the State shall take additional measures. 5. With this direction the writ petition shall stand disposed of. 6. We make it clear that we have not addressed specific complaint of the writ petitioner on merits in this writ petition. 7. It shall be for the Health Secretary to examine the petitioner’s grievance brought on behalf of general public and take appropriate measures.
