JUDGMENT Kanwaljit Singh Ahluwalia, J. - The present petition has been filed under Section 482 Cr.P.C., 1973 praying that proceedings arising out FIR No.333/2017 registered at Police Station Gandhi Nagar, Jaipur (East) for the offences under Sections 332 and 353 IPC, be quashed. 2. In the present case, the complainant Suresh Sharma in the FIR stated that students were demonstrating before the office of Vice Chancellor and one of the student / petitioner caught hold of the collar of one teacher namely Dr. RN Sharma. 3. Today, Suresh Sharma respondent no.2 and Dr. R.N. Sharma, respondent no.3 are present in the court and they have been identified by their counsel Mr. Pradeep Khandelwal. Dr. RN Sharma has stated that a teacher cannot spoil the career of the student, as the teacher is one who has to mould and rear students. He has stated that students were agitating and in a melee one student misbehaved and even if assuming allegation is true, he will still wish a bright future and career for his student. 4. This Court appreciate teacher-taught relationship. This Court is of view that if the teacher is willing to forgive his student, the court should not stand in the way. 5. Considering the magnanimity shown, it will be not be appropriate for this Court to adjudicate the mute question that if the teacher is standing in front of office of Vice Chancellor, he will be public servant or not. By accepting pardon granted by the teacher to the student upon prayer made by teacher to this Court it will not be expedient to prosecute the petitioner student. 6. Consequently, the present petition is accepted and the impugned FIR is quashed along with all subsequent proceedings.
