JUDGMENT : Amol Rattan Singh, J. Pursuant to the order of this Court dated 17.04.2018, an affidavit of Sh. Pritam Singh, PPS, Senior Superintendent of Police, Ferozepur, has been filed in Court today by learned State counsel, which is taken on record. A copy thereof has been given to learned counsel for the petitioner. 2. A perusal of the aforesaid affidavit shows that in fact the petitioner and his co-accused Jakir Husain are stated to have admitted in writing that they had obtained Rs. 3,00,000/- from the complainant, on the promise that they would send his grand-son abroad. After they could not do so, the petitioner, as also Jakir Husain, had promised to pay an amount of Rs. 3,00,000/- in six installments, in respect of which six cheques were also issued. 3. A photocopy of one of the cheques in favour of the complainant, Janak Raj, has also been produced in Court today by learned counsel for the complainant. 4. That being so, without making any comment on the actual culpability or otherwise of the petitioner in the offence alleged to have been committed, which would be gone into by the investigating agency, and the competent Court at the appropriate stage, on the basis of evidence gathered/led, I see no reason to entertain this petition, even though learned counsel for the petitioner submits that there are discrepancies in the amount. 5. Dismissed.
