JUDGMENT : Amol Rattan Singh, J. By this petition, quashing of FIR No. 18 dated 17.01.2017, is sought, registered against the petitioner at Police Station Sadar, Jalandhar, Police Commissionerate, Jalandhar, alleging therein the commission of offences punishable under Sections 406, 420, 465, 467 and 468 of the IPC, on the basis of a compromise arrived at between the petitioner (accused) and respondent no. 2, i.e. the complainant. 2. Vide an order of this Court dated 21.03.2018, the parties were directed to appear before the learned trial Court to get their statements recorded, in terms of the compromise. 3. Pursuant to the aforesaid order, the report of the learned Additional Chief Judicial Magistrate, Jalandhar, has been received, stating that on 16.04.2018 the complainant-respondent no. 2, Ashok Kumar, appeared before that Court and made a statement that he has compromised the matter with the petitioner voluntarily and had received Rs. 2,50,000/- in terms of the compromise deed. 4. A perusal of the said agreement (Annexure P-2) shows that Rs. 2,00,000/- were to be paid to the complainant at the time of the execution of the agreement, i.e. 09.12.2017, with Rs. 2,50,000/- to be paid at the time 'when the FIR was quashed.' 5. That being so, with the statement made by the complainant also having been annexed with the report of the learned Magistrate, which further states that nothing remains due to him from the petitioner, and as per the assessment of the Magistrate, the compromised also being “genuine and valid”, the petition is allowed and FIR No. 18 dated 17.01.2017, registered against the petitioner at Police Station Sadar, Jalandhar, Police Commissionerate, Jalandhar, for the alleged commission of offences punishable under Sections 406, 420, 465, 467 and 468 of the IPC, along with all proceedings emanating therefrom, is hereby quashed.
