ORDER 1. Challenge in the present writ petition is to an order passed by the Member, Board of Revenue, Gwalior (M.P.) on 8.5.2015 whereby the private respondents were found to be necessary party in deciding the question of inheritance after death of Smt. Asha Rani, who died issueless and her property stands escheat to the State. The present petitioner raised his claim on the estate of the deceased as adoptive son whereas, the private respondents claimed title of land being purchaser from the previous owner. The learned Commissioner set aside the order of the Tahsildar that the parties should get resolved their dispute by the civil Court. The Collector affirmed the order in appeal. The Board of Revenue allowed the revision of the private respondents and sent back the matter to the Commissioner for fresh decision after giving opportunity of hearing to all the claimants. 2. We do not find any error in the order passed by the learned Member of the Board of Revenue as the issue of inheritance of Asha Rani has to be decided after giving opportunity of hearing to all the factions including State. 3. Consequently, we do not find any merit in the present writ petition. The same is dismissed.
