JUDGMENT : Amol Rattan Singh, J. 1. By this petition, filed under Section 439 Cr.P.C., the petitioner seeks the concession of 'regular bail'. 2. The petitioner not having been named in the FIR and the allegation against him being based on a disclosure statement, that he had made a reconnaissance of the area; and further, with he having been in custody for about 11 months, without making any comment on his culpability or otherwise, which would be gone into by the trial court on the basis of the evidence led before that Court, this petition is allowed. 3. Consequently, the petitioner would be enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
