JUDGMENT : MAHABIR SINGH SINDHU, J. 1. Present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to both the petitioners, namely, Gulab Singh and Hardeep Singh @ Harman in cross-case, registered vide DDR No.47 dated 24.08.2017, under Sections 452, 324, 34 (Section 452, IPC deleted and Section 458, IPC added later on), registered at Police Station Tanda, District Hoshiarpur, registered in main case bearing FIR No.179 dated 20.08.2017, under Sections 323, 324, 34 of the Indian Penal Code, registered at Police Station Tanda, District Hoshiarpur. 2. This Court, while issuing notice of motion on 23.04.2018, passed the following order:- “It is contended by learned counsel for the petitioners that the parties have already compromised the matter and a quashing petition bearing CRM-M-957 of 2018 has already been filed, which is stated to be pending before a co-ordinate Bench. Notice of motion for 23.5.2018. In the meanwhile, the petitioners are directed to join investigation before the Investigating Officer. In the event of their arrest, the Arresting Officer would admit them on interim bail till the next date of hearing on their furnishing adequate bail and surety bonds to his satisfaction. The petitioners are also directed to abide by all the conditions as envisaged under Section 438(2) Cr.P.C.” 3. Learned Counsel for the petitioners stated that in pursuance of order dated 23.04.2018 of this Court, both the petitioners have joined the investigation and their custodial interrogation is no longer required. 4. The above factual position is duly acknowledged by learned State Counsel, on instructions from H.C. Paramjit Singh, by submitting that the petitioners have joined the investigation and their custodial interrogation is no longer required in this case. 5. In view of above, interim order dated 23.04.2018 of this Court is made absolute, subject to the conditions as envisaged under Section 438(2) Cr.P.C. and the present petition stands disposed off.
