JUDGMENT : AMOL RATTAN SINGH, J. 1. Custody certificate of the petitioner has been filed in Court today by learned State counsel, which is taken on record. 2. Learned counsel for the petitioner points to the last order of this Court dated 14.05.2018, to submit that though a statement had been made by learned State counsel (on instructions) that the complainant had been summoned to testify before the trial Court on 21.05.2018, as a matter fact the case had not even been committed to the Court of Sessions by that date. 3. He further reiterates that a co-accused, Dinesh, has already been admitted to bail by this Court on 19.04.2018. 4. Though it is seen that the said Dinesh was admitted to bail on the ground that though a baseball bat injury was attributed to him, no such injury would be seen from the MLR (presently Annexure P-2 with the petition); however, considering the fact that the petitioner has been in custody for 04 months and 05 days, with no other criminal case shown to be registered against him as per the custody certificate filed in Court today by learned State counsel, and there are 16 witnesses to be examined as per learned counsel for the petitioner, without making any comment on the actual merits of the case for or against the petitioner, I consider it appropriate to admit him to bail upon his furnishing adequate bail and surety bonds to the satisfaction of the learned trial Court. 5. A copy of this order, however, be given to learned State counsel for onward conveyance to the Deputy Commissioner of Police, Ludhiana, who would furnish a report giving therein as to why police officials coming to ostensibly assist State counsel are giving absolutely false information to the counsel. 6. For that purpose, this case file be put up for hearing on 06.07.2018.
