JUDGMENT : AMOL RATTAN SINGH, J. 1. By this petition, filed under Section 439 Cr.P.C., the petitioner seeks the concession of 'regular bail'. 2. Vide an order dated 23.04.2018 this petition had been adjourned till today, with the trial Court directed to ensure that the prosecution witness, Sadhu Singh, as also the investigating officer, ASI Kuldeep Singh, are examined at the outset. 3. Today learned State counsel, on instructions from the police official who is present in Court to assist him, submits that both the said witnesses have been examined, with the complainant and her son also having been examined (as noticed earlier also). 4. That being so, with the petitioner having been in custody for about 8 months and the remaining prosecution witnesses still to be Crl. Misc. No.M-49034 of 2017(O&M) examined, I deem it appropriate to admit the petitioner on bail during the pendency of the trial. 5. Consequently, without making any comment on the actual merits of the case, for or against the petitioner, this petition is allowed. The petitioner would be enlarged on bail, upon his furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
