JUDGMENT Aparesh Kumar Singh, J. - Heard learned counsel for the petitioner and the State. 2. Petitioner seeks compassionate appointment on the death of his father in harness on 30.12.2014 while working on the post of Clerk in Anusuchit Jan Jati Awashiya Uchcha Vidyalaya, Sanjay Saraikela (S.T. High School, residential, Sanjay Saraikela). According to the petitioner, deceased has left behind his widow and the petitioner. After death of the father, petitioner approached Respondent no. 4 and 5 for getting employment on compassionate ground and filled up the prescribed form with necessary enclosures and declaration. Petitioner and his mother has also submitted some affidavits in this regard. Petitioner has passed Matriculation examination from the Jharkhand Academic Council, the certificate of which is at page 27 where his date of birth is shown as 15.01.1995. As such he is within the permissible age for seeking employment. Petitioner has passed Intermediate Science Examination 2013 under the JAC in 2nd Division as per certificate at page 25 dated 28.05.2013. Despite having completed these formalities his application has not been finally considered. Respondents have given assurance but no decision has been taken as yet. Therefore, he has approached this Court as representation made before the Deputy Commissioner, Seraikela Kharsawan vide annexure-6 series failed to redress his grievance. 3. Learned counsel for the respondent State submits that matter has been taken up for the first time and therefore instructions are awaited. However, he submits that in case decision has not been taken on his application, the competent authority/ Deputy Commissioner cum Chairman, District Compassionate Appointment Committee, Seraikela Kharsawan, respondent no.4 may be directed to take a decision in the matter in accordance with law. 4. Considered the submission of learned counsel for the parties in the light of the material pleadings borne on record.

Since the case is of compassionate appointment of the petitioner on the death of his father on 30.12.2014 in harness while working as a Clerk in the School in question, at this stage, it is deemed appropriate to dispose of the writ petition with a direction upon the competent authority / respondent no.4, Deputy Commissioner cum Chairman, District Compassionate Appointment Committee, Seraikela Kharsawan to take a decision on the application of the petitioner if not yet decided, after due scrutiny of the relevant record of the deceased employee and the eligibility of the petitioner in accordance with law and applicable resolution of the State Government within a reasonable time preferably 12 weeks from the date of receipt of copy of this order along with his representation. 5. Writ petition stands disposed of accordingly.
