JUDGMENT : MAHABIR SINGH SINDHU, J. 1. Present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case bearing FIR No.184 dated 20.10.2017, under Sections 406 & 420 of the Indian Penal Code and Section 24 of the Immigration Act, 1983, registered at Police Station Division No.5, District Police Commissionerate Jalandhar. 2. This Court, while issuing notice of motion on 20.02.2018, passed the following order:- “It is contended that although there is an allegation in the FIR that an amount of Rs. 6.5 lacs was handed over to the petitioner but despite that petitioner had already issued a cheque of Rs. 10 lacs dated 24.03.2017 and on account of dishonor of the same, complaint under Section 138 of the Negotiable Instrument Act has already been filed by the complainant. Adjourned to 20.03.2018. 3. In view of the above, petitioner is directed to join the investigation before the Investigating Officer. In the event of his arrest, the Arresting Officer would admit him to bail on his furnishing adequate bail and surety bonds to his satisfaction. The petitioner is also directed to abide by all the conditions as envisaged under Section 438(2) Cr.P.C.” 4. Learned Counsel for the petitioner stated that in pursuance of order dated 20.02.2018 of this Court, the petitioner has joined the investigation and his custodial interrogation is no longer required. 5. The above factual position is duly acknowledged by learned State Counsel, on instructions from ASI Kewal Singh, by submitting that the petitioner has joined the investigation on 17.04.2018 and his custodial interrogation is no longer required in this case. 6. In view of above, interim order dated 20.02.2018 of this Court is made absolute, subject to the conditions as envisaged under Section 438(2) Cr.P.C. and the present petition stands disposed off.
