body2018
JUDGMENT Mr. Mahesh Grover, J.; (Oral)- The limited grievance raised before us in the present petition is that even though proceedings have been initiated against the orders passed by the competent authority under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961, holding the petitioners to be in unauthorised occupation of Panchayat land, the Court of Commissioner is not taking any decision. Even the application for stay has remained undecided. 2. We have been informed that next date in that case is 21.06.2018. 3. Looking at the nature of grievance raised, we deem it appropriate to dispose of the instant petition without issuance of notice of motion to the other side on account of the direction that we intend to pass. 4. We direct the Court of Commissioner, before whom the proceedings are pending, to decide the matter expeditiously, in particular decide the application for stay on the date fixed i.e. 21.06.2018. 5. Till the next date of hearing i.e. 21.06.2018 the dispossession of the petitioners shall remain stayed. 6. If the stay application is not decided till that date, the benefit shall enure to the petitioners for another period of 15 days during which the said authority shall positively decide the application. 7. Petition stands disposed of.
