JUDGMENT : Mahabir Singh Sindhu, J. Present petition under Section 438 of the Criminal Procedure Code ('Cr.P.C.' - for short) has been filed by the petitioner(s) for grant of anticipatory bail in FIR No.104 dated 31.3.2018 under Sections 6/17 Protection of Children from Sexual Offences Act (for short 'the Act') registered at Police Station Nissing, District Karnal. 2. While issuing notice of motion on 13.4.2018, following orders were passed:- “It is contended by learned counsel for the petitioner that present case was initiated at the instance of vested interest of the village against whom father of the petitioner, who is Sarpanch of the village, had initiated proceedings for ejectment from the common land and had also initiated criminal proceedings for the same reason. It is further contended that the petitioner is a minor. Notice of motion for 25.05.2018. Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C.” 3. Learned State counsel on instructions from ASI Sultan Singh has submitted that the petitioner has joined investigation in this case on 24.4.2018 and his custodial interrogation is not required anymore. 4. In the light of above circumstances, interim bail granted to the petitioner vide order dated 13.4.2018 is made absolute subject to conditions envisaged under Section 438(2) Cr.P.C. 5. Petition stands disposed off.
