MAHABIR SINGH SINDHU

body2018
JUDGMENT : MAHABIR SINGH SINDHU, J. 1. This petition has been filed by the petitioner under Section 439 of the Criminal Procedure Code ('Cr.P.C.' - for short) for grant of regular bail in FIR No. 65 dated 06.03.2018 under Section 384, 342, 420, 506, 34 IPC registered at Police Station City Tarn Taran. 2. It is contended by learned counsel for the petitioner that as per allegations in the FIR petitioner has given beatings to one police official who has not come forward, rather present FIR has been lodged by Meha @ Gurleen Kaur. It is further contended that petitioner is in custody since 08.03.2018 and the challan has already been presented under Section 173 Cr.P.C., and nothing is to be recovered from the petitioner. 3. Learned State counsel has duly acknowledged the above factual position on instructions from HC Jagjit Singh. 4. Heard both sides. 5. In view of the fact that attribution against the petitioner is that he dragged one police official but said official has not come forward as the present FIR has been lodged by Meha @ Gurleen Kaur. 6. Consequently, this Court is of the view that it would be just and appropriate if the concession of bail is granted to the petitioner. Therefore, in view of the abovesaid circumstances, without expressing any opinion on the merits of the case, this petition is accepted. Petitioner-Gurpreet Singh alias Gopi be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate.
