JUDGMENT : MAHABIR SINGH SINDHU, J. 1. Present petition has been under Section 482 Code of Criminal Procedure (for short 'Cr.P.C.') for seeking protection of life and liberty of the petitioner and for issuing a direction to respondent No. 3 to not to call him to the police station without following the due procedure. 2. Learned counsel for the petitioner has confined his prayer to the effect that in case the investigating officer is directed to issue a prior notice under Section 160 Cr.P.C. before calling the petitioner to the police station, then he will be satisfied. 3. The prayer of learned counsel for the petitioner seems to be justified and the same is hereby accepted. 4. Undisputedly, an FIR No. 194 dated 23.06.2016, under Section 420 IPC was registered at Police Station Tripari, District Patiala against the present petitioner and after investigation, the police has submitted the cancellation report in that FIR. 5. The allegation of the petitioner is that despite above-said factual position, he is being called by the police time and again. 6. Since the cancellation report has already been submitted by the police, therefore, this Court deems it appropriate to direct respondent No. 3 that in case the presence of petitioner is require by the police in the above-said FIR, then, he be issued a prior notice of at least one week under Section 160 Cr.P.C. 7. The present petition stands disposed off in the above terms.
