JUDGMENT : AMOL RATTAN SINGH, J. CRM-20109-2018 1. Pursuant to the order dated 24.05.2018, this application has been filed, seeking to place on record various order passed by the trial Court between 13.10.2017 to 13.03.2018, as Annexures P-8 to P-11. 2. The application is allowed and the copies of the aforesaid orders are ordered to be taken on record as Annexures P-8 to P-11, subject to all just exceptions. CRM-M-22402-2018 3. A perusal of the aforesaid orders, dated 13.10.2017, 04.12.2017, 18.01.2018 and 13.03.2018, show that the petitioner was always present on all those dates, with the trial having been adjourned to 08.05.2018 on 13.03.2018, on which date he did not appear, leading to the passing of the impugned order, by which his bail bonds have been ordered to be forfeited and bail cancelled. 4. Thus, the contention is that the petitioner could not appear only on one date, leading to the aforesaid order, which (as per the usual contention), is that his counsel had noted the wrong date. 5. Without going into that matter in detail, seeing the fact that the petitioner has actually been present on all earlier dates that he was summoned, (as per the orders referred to hereinabove), this petition is disposed of with a direction to the trial Court that upon the petitioner surrendering before that Court, he would be admitted to interim bail to the satisfaction of that Court, with the bail to be confirmed or rejected subject to verification of the fact that he indeed remained absent only on one date. 6. Thus, the final order with regard to the grant of bail being made absolute or otherwise, would be passed by the trial Court itself, accordingly.
