JUDGMENT : Amol Rattan Singh, J. Despite the fact that vide the order dated 14.05.2018, this Court had directed notice be issued to the newly added respondent, i.e. the Secretary, Ministry of External Affairs, Government of India, with the said respondent to be served through the learned Assistant Solicitor General of India (posted to this Court), as per the report of the Registry learned counsel for the petitioner had not filed the process fee. 2. I see no reason to continue with this order in favour of the petitioner, the allegation being that one of his co-accused Sukhmit alias Ricki had duped the complainant and even told him that he had got a visa from France for him. 3. It was in view of the fact that the police was not able to obtain any information from the French Embassy, that the Secretary, Ministry of External Affairs had been impleaded as a party, so as to try and ensure that information is obtained from the French Embassy. 4. Obviously, the addition of the aforesaid respondent did not seem to augur well for petitioner, he not having filed the process fee. 5. Consequently, this petition is dismissed and the interim order stands vacated. 6. However, nothing stated hereinbefore shall be taken to be an observation on the actual merits of the case for or against the petitioner, which would be gone into by the investigating agency and the competent court at the appropriate stage, on the basis of the evidence gathered/led before it.
