JUDGMENT Sujit Narayan Prasad, J. - This writ petition has been filed for issuance of a direction upon the respondents to consider the case of the petitioner for appointment on compassionate ground under the respondent-Ranchi, Municipal Corporation, on account of the fact that his father has died in harness on 14.01.2011, while working as a 4th Grade Employee. 2. On inquiry, counsel for the petitioner submits that due application for appointment on compassionate ground has been filed before respondent no.2, but copy of the same has not been annexed along with the instant writ petition. 3. Learned counsel appearing for the Respondent-Ranchi Municipal Corporation submitted that there is no scheme at the moment for appointment on compassionate ground. He further submits, by placing reliance on Annexure-C to the counter affidavit, that the Cadre Service Rule is under process and as such, at present no direction can be issued so far as the question of appointment on compassionate ground is concerned. 4. Upon this, learned counsel for the petitioner submits that the process for formulating the Cadre Service Rule is pending since long and till date no decision has been taken and therefore, he submits that the writ petition may be disposed of by giving liberty to the petitioner to approach the concerned authority of the Respondent - Ranchi Municipal Corporation for consideration of the claim of the petitioner for appointment on compassionate ground, if a representation in this regard is filed before the said authority. 5. Counsel for the respondents does not object to such prayer made by the counsel for the petitioner. 6. In view of the above, this writ petition is disposed of with a liberty to the petitioner to file representation before the concerned authority of respondent- Municipal Corporation Ranchi, who may look into the matter and take decision in accordance with law and without being prejudiced by any observation made by this court and he shall take an independent decision in this regard.
