JUDGMENT Mr. Fateh Deep Singh, J. (Oral):- Allegations against the petitioner Liyakat in this first anticipatory bail application filed under Section 438 Cr.P.C. are that the police of Police Station Nuh, on the basis of a secret information that the petitioner is slaughtering a cow in his courtyard, conducted raid but the petitioner, who was not identified even by the police at the time of raid, managed to escape and from that place certain articles used for slaughtering, including a newly born calf and cow-skin was also recovered, leading to registration of the present case. 2. Contentions of learned counsel for the petitioner are that the petitioner is neither identified at the spot nor apprehended and there is nothing suggestive to show that the petitioner was instrumental in this crime. Learned State counsel on instructions from ASI Bhagwat Prasad, has stoutly opposed grant of bail on the grounds of heinousness of the offence and seriousness of allegations and that the investigations are still underway. 3. Appreciating the submissions, the own stand of the State that the question of identity of the petitioner is based on hearsay and thus a debatable issue having been arisen over its acceptability and legality, together with the fact that recovery, if any, has already been effected and that nothing more is to be recovered from the petitioner, his joining the investigations will suffice the purpose. Accordingly, the petitioner is directed to put in appearance before the investigating officer and on his doing so, he shall be released on interim bail to the satisfaction of investigating officer. He shall continue to join investigation as and when called for and shall furnish an undertaking that he shall abide by the conditions specified under Section 438 (2) Cr.P.C. Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. 4. The petition stands disposed off accordingly.
