JUDGMENT Mr. Fateh Deep Singh, J. (Oral) : This order shall dispose off first regular bail application filed by the petitioner Pritpal Singh under Section 439 CrPC in case FIR No.91 dated 02.10.2015 registered at Police Station SBS Nagar under Section 498-A IPC. 2. Allegations against the petitioner are that the present case was got registered on 02.10.2015 on the statement of Daljit Kaur wife of the petitioner on account of matrimonial dispute, in which the petitioner was initially declared a proclaimed offender on 20.05.2016 and subsequently on return to India was arrested on 12.05.2018. 3. Contentions of the learned counsel for the petitioner are that the petitioner was unaware of the registration of FIR as he was abroad and he had no intention to run away from the law and that he is behind bars since a long time for allegations levelled under Section 498-A IPC only. 4. Learned State counsel has sought to oppose the grant of bail to the petitioner on the grounds that the petitioner was initially declared a proclaimed offender and might again abscond if allowed bail. 5. Appreciating the submissions of the two sides, it is admitted stand of both sides that co-accused of the petitioner have already been acquitted in the present case. The petitioner is behind bars since more than 25 days. Culpability, if any, shall be determined at the time of trial which is not likely to conclude in the near future. In view thereof, this Court is of the opinion that no useful purpose will be served by keeping the petitioner in custody. However, to safeguard the interests of the State, the petitioner is ordered to be released on regular bail on his furnishing heavy bail bonds in the sum of Rs.50,000/- with two sureties, each of the like amount, to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, S.B.S. Nagar. 6. The petition stands disposed off accordingly.
