JUDGMENT Mr. Amit Rawal, J.:(Oral)-The prayer in the petition is for grant of regular bail to the petitioner, who is in custody from 28.03.2018 in respect of FIR bearing No.38 dated 28.03.2018 registered under Sections 323, 326, 34 IPC lodged at Police Station Nangal, District Roopnagar wherein other co-accused has been granted concession of regular bail by Sessions Judge vide order dated 15.05.2018. 2. Learned counsel appearing for the petitioner submitted that serious injuries attributed to the petitioner is not on account of the act of the petitioner but owing to certain other iron article which hit on the head of the complainant when he fell down, resulting into alleged injury which is 6 cm x 1 cm deep. 3. Mr. Nikhil Kumar Chopra, Addl. A.G., Punjab on instructions from ASI Balbir Kumar submitted that charges have been framed in the aforementioned case but no witness has been examined but he did not dispute the concession of regular bail granted to the other co-accused. 4. I have heard learned counsel for the parties, appraised the paper book and of the view that it would be a matter of trial to prove allegation against the petitioner regarding the attribution of the injuries suffered by the injured-complainant as to whether a case is made out under the Sections mentioned in the FIR but in the meantime, it would not be in the fitness of things to keep the petitioner behind bars as the conclusion of trial is likely to take some time 5. Without commenting upon merits and demerits of the case as it would be subject matter of trial and keeping in view the aforementioned facts and circumstances, I deem it appropriate to grant concession of regular bail to the petitioner. Resultantly, the crl. petition is allowed and the petitioner is ordered to be released on bail subject to furnishing of bail bonds to the satisfaction of the Duty Magistrate/CJM, Roopnagar.
